Intangible cultural heritage is an invaluable treasure for human being and China is a country endowed with rich ICH. Among all the measures of safeguarding ICH, intellectual property tools are effective while controversial. As China started relatively late in the legal protection of ICH, the gap between legislation and judiciary needs to be filled in. This study examines the IP protection of ICH in China based on the current laws and regulations and then provides a semiotic approach to the relevant (...) legal evolution in China. This study, taking in some experiences outside China, goes further to provide recommendations for improving the IP protection in China. (shrink)

One way of understanding the reduplicative formula ‘Christ is, qua God, omniscient, but qua man, limited in knowledge’ is to take the occurrences of the ‘ qua ’ locution as picking out different parts of Christ: a divine part and a human part. But this view of Christ as a composite being runs into paradox when combined with the orthodox understanding of the Incarnation, according to which Christ is identical to the second person of the Trinity. Extant literature suggests a positive correlation between social trust (also called generalized trust) and life satisfaction. However, the psychological pathways underlying this relationship can be complex. Using the Bayesian Mindsponge Framework (BMF), we examined the influence of social trust in a high-violence environment. Employing Bayesian analysis on a sample of 1237 adults in Cali, Colombia, we found that in a linear relationship, generalized trust is positively associated with life satisfaction. However, in a model including the interactions between trust and education (...) level as well as between trust and socioeconomic status, generalized trust is found to be negatively associated with life satisfaction. In this non-linear relationship, both education level and socioeconomic status have moderating effects against the negative association between generalized trust and life satisfaction. In other words, less educated people living in worse socioeconomic conditions are more likely to have lower life satisfaction when they have higher levels of social trust. In contrast, highly educated people living in better socioeconomic conditions are more likely to have higher life satisfaction when they have higher levels of social trust. Due to the facilitating function of trust in information processing, lowering the rigor of the filtering system in a high-violence social environment will likely put an individual at risk. Based on our findings, we suggest that policymakers should consider the impacts of social contexts when advocating for increasing social trust. Characteristic of metaphysics are general questions of existence, such as ‘Are there numbers?’ This kind of question is the target of Carnap's argument for deflationism, to the effect that general existential questions, if taken at face value, are meaningless. This paper considers deflationism in a theological context, and argues that the question ‘Does God exist?’ can appropriately be grouped with the ‘metaphysical’ questions attacked by Carnap. Deflationism thus has the surprising consequence that the correct approach to theism is that of (...) radical theology. The paper attempts to show why Carnap's argument fails, and why, nevertheless, enough remains of it for us to conclude that God cannot be outside time and space. (shrink)

According to a plausible and influential account of perceptual knowledge, the truth-makers of beliefs that constitute perceptual knowledge must feature in the causal explanation of how we acquire those beliefs. However, this account runs into difficulties when it tries to accommodate time perception – specifically perception of order and duration – since the features we are apparently tracking in such perception are not causal. The central aim of the paper is to solve this epistemological puzzle. Two strategies are examined. The (...) first strategy locates the causal truth-makers within the psychological mechanism underlying time perception, thus treating facts about time order and duration as mind-dependent. This strategy, however, is problematic. The second strategy modifies the causal account of perceptual knowledge to include a non-causal component in the explanation of belief-acquisition, namely chronometric explanation. Applying this much more satisfactory approach to perceptual knowledge of time, we can preserve the mind-independence of order and duration, but not that of time's flow. (shrink)

Precognition is an anomaly in information transmission and interpretation. Extant literature suggests that paranormal beliefs and gender may have significant influences on this unknown information process. This study examines the effects of these two factors, including their interactions, on precognition performance by employing the Bayesian Mindsponge Framework (BMF) analytics. Using Bayesian analysis on secondary data of 60 participants, we found that men may have higher chances to score a hit in a precognition task compared to women. Interestingly, stronger beliefs in (...) the paranormal may decrease the success probability in performing precognition tasks. Considering the interactions between the two factors, the effect of paranormal beliefs on precognition task performance is stronger in men than women. Using mindsponge-based reasoning, we argue that paranormal beliefs may increase the interference of imagination in the reception of hypothetical precognitive information. Women tend to rely more on intuition, which may lessen the interference effect of imagination on hypothetical psi reception. Based on the findings, we suggest that researchers should be careful when assessing participants’ psi potential for experiments. We also demonstrate some advantages of utilizing the BMF in parapsychological research. (shrink)

In her recent book _A Duty to Resist_ (2018), Candice Delmas contends that both beneficiaries and victims of injustices have a duty to resist unjust laws and to try to change them, and proposes several ways of grounding this duty. One of these proposed groundings appeals to considerations of fairness. Delmas holds that anyone who refuses to participate in resisting some injustice, including victims of that injustice, can be accused of free-riding and thus of unfair conduct that violates the duty (...) of fair play, which means that they have a fairness-based duty to resist. In this paper, I critique this attempt to ascribe a duty to resist grounded in considerations of fairness specifically to victims of injustice. Against Delmas, I argue that victims of injustice do not have this fairness-based duty to resist because, unlike the beneficiaries of an injustice, they cannot be considered free-riders when they do not participate in resistance to the injustice. I then discuss additional problematic implications of Delmas’s view, focusing on the issue of victim-blaming, and show how these problems can be avoided. In this way, I hope to contribute to the urgent project of determining who has a duty to resist injustice. (shrink)

Is time flowing? A-theorists say yes, B-theorists say no. But both take time to be real. It means that B-theorists accept that time might be real, even if lacking a property usually ascribed to it. In this paper, I want to ask what are the different properties usually ascribed to time in order to draw the list of different possible kinds of realism and anti-realism about time. Among the categories of the telecom and internet frauds, the online romance scam is of particular concern for its sharp rise of victim numbers and the huge amount of cost. A social semiotic approach could be used to investigate the victim identity of the online romance scam from the aspects of the (re)construction and interpretation of discursive practices. The demise of the value-free ideal constitutes a threat to public trust in science. One proposal is that whenever making value judgments, scientists rely only on democratic values. Since the influence of democratic values on scientific claims and recommendations is legitimate, public trust in science is warranted. I challenge this proposal. Appealing to democratic values will not suffice to secure trust because of at least two obstacles: polarization and marginalization.

The present volume collects essays on the philosophical foundations of quantum theories of gravity, such as loop quantum gravity and string theory. Central for philosophical concerns is quantum gravity's suggestion that space and time, or spacetime, may not exist fundamentally, but instead be a derivative entity emerging from non-spatiotemporal degrees of freedom. In the spirit of naturalised metaphysics, contributions to this volume consider the philosophical implications of this suggestion. In turn, philosophical methods and insights are brought to bear on the (...) foundations of quantum gravity itself. An ingenious argument – we may call it the Argument from Excuse – purports to show that the Standard View of Ignorance is false and the New View of Ignorance is true. On the former, ignorance is lack of knowledge; on the latter, ignorance is lack of true belief. I defend the Standard View by arguing that the Argument from Excuse is unsound. I articulate and defend a conception of skepticism inspired by Aristotle’s doctrine of the mean. On it, skepticism is vicious when deficient and when excessive. Virtuous skepticism lies as a mean between these two extremes.

For this handbook, we decided to combine a first strategy that looks at different research approaches and asks for their specific contribution to the study of science communication. This is the aim of section I. A second and third strategy is to describe main topics and central aspects of internal and external science communication. This is the aim of sections II and III, respectively: In section II the authors deal with text types, media, and practices of internal science communication. Section (...) III is devoted to external science communication and the relation between science, scientists, and the public. A fourth strategy is based on an evolutionary perspective: How has science communication evolved, what are current trends, and what could or should be future developments? I then provide a taxonomy of ontological conceptions of the nature of propositions, and explore several of their interesting epistemological implications.

L'actualité d'un livre aussi significatif dans le parcours philosophique d'un auteur que Le bruit du sensible est souvent prétexte à interroger la place qu'occupe une pensée dans la vie intellectuelle contemporaine. À ce titre, l'œuvre de Jocelyn Benoist est particulièrement éloquente d'un questionnement qui, venu de la phénoménologie, s'est peu à peu ouvert à des enjeux qui excèdent le registre phénoménologique, voire qui le désertent avec fidélité, c'est-à-dire avec un esprit critique, vigoureux, et d'une extraordinaire fécondité. Jocelyn Benoist nous mène (...) sur la voie d'un chemin sans retour en direction du sensible. Le sensible découvert comme dimension à part entière de la réalité elle-même (et non de notre rapport à la réalité), autrement dit de notre appartenance de plain-pied à la réalité, dont une certaine philosophie a pu croire que nous en étions séparés et qu'il nous fallait, par le biais de la perception, y accéder. Tel est le bruit du sensible, celui d'un être à part entière, et non plus d'un apparaître distinct de l'être servant de sas d'accès intentionnel ou conceptuel à celui-ci. Les contributions réunies dans le présent volume se veulent apporter un contrepoint à cette résonance équivoque et tentent de cerner au plus près ce que Jocelyn Benoist entend substituer au sens perceptuel de la phénoménologie, à savoir la notion de bruit. Leo Strauss (1899-1973) a inscrit sa pensée dans l'héritage de la tradition grecque, mais également dans celui de la tradition biblique. Se rapportant au judaïsme comme à une révélation de la Loi (pour laquelle la dimension de la foi est secondaire), il fait retour à une pensée juive (Pourquoi nous restons juifs) et tente de prolonger la réflexion de Maïmonide dans les conditions nouvelles des temps présents. Il s'oppose ainsi à sa rénovation par l'approche phénoménologique de Franz Rosenzweig comme à (...) la pensée de Martin Buber, tout en se tenant à distance de la réflexion sur le mysticisme juif de Gershom Scholem avec lequel il dialogue. Cet ouvrage interroge la manière dont Strauss pense les relations de corrélation et de conflit entre philosophie et judaïsme. En quoi la réflexion sur la Loi, dont il poursuit l'élaboration dans la lignée de la pensée médiévale et à contre-courant de la modernité des Lumières, représente- t-elle un approfondissement de la pensée juive et jette-t-elle une lumière crue sur la situation du judaïsme dans le monde? Quels sont les termes du débat avec les penseurs contemporains du judaïsme avec lesquels il est en relation? Quelles sont aujourd'hui les possibilités et les limites d'une telle réflexion pour la vitalité du judaïsme et de la philosophie? Les études présentes ouvrent des voies différentes, voire divergentes, essentiellement heuristiques, sur les possibilités et les limites de la réflexion straussienne pour la vitalité du judaïsme et de la philosophie. After reviewing the literature on current knowledge about consciousness in humans, we present a state-of-the art discussion on consciousness and related key concepts in animals. Obviously much fewer publications are available on non-human species than on humans, most of them relating to laboratory or wild animal species, and only few to livestock species. Human consciousness is by definition subjective and private. Animal consciousness is usually assessed through behavioural performance. Behaviour involves a wide array of cognitive processes that have to be (...) assessed separately using specific experimental protocols. Accordingly, several processes indicative of the presence of consciousness are discussed: perception and cognition, awareness of the bodily-self, self-related knowledge of the environment (including social environment). When available, specific examples are given in livestock species. Next, we review the existing evidence regarding neuronal correlates of consciousness, and emphasize the difficulty of linking aspects of consciousness to specific neural structures across the phyla because high-level cognitive abilities may have evolved independently along evolution. Several mammalian brain structures (cortex and midbrain) are involved in the manifestations of consciousness, while the equivalent functional structures for birds and fishes would likely be the pallium/tectum and midbrain. Caution is required before excluding consciousness in species not having the same brain structures as the mammalian ones as different neural architectures may mediate comparable processes. Finally, specific neurophysiological mechanisms appear to be strongly linked to the emergence of consciousness, namely neural synchrony and neural feedback. Considering the limited amount of data available and the few animal species studied so far, we conclude that different manifestations of consciousness can be observed in animals but that further refinement is still needed to characterize their level and content in each species. Further research is required to clarify these issues, especially in livestock species. (shrink)

ObjectiveTo explore the effect of modified constraint-induced movement therapy on upper limbs residual dysfunction for infancy with the sequelas of unilateral brachial plexus injury.MethodsSingle blind randomized controlled trial of mCIMT vs. standard care. An enrolling 31 infants with a uBPI exhibiting residual dysfunction of the affected upper limb for over 6 months was conducted. And functional outcomes pertaining to the affected upper limb were assessed via AMS, GRES, RHS, and MSS at 0, 3, and 6 months after treatment.ResultsNo differences were (...) found in baseline AMS, MSS, GRES, or RHS between the control and mCIMT groups [F = 0.062, P = 0.086; F = 0.483, P = 0.499; F = 0.272, P = 0.610; Z = −0.336, P = 7.373]. At the 3- and 6-month follow-up time points, AMS, MSS, and GRES scores were significantly improved over baseline in both groups [mCIMT: F = 183.750, 128.614, 110.085, P < 0.05; Control: F = 204.007, 75.246, 51.070, P < 0.05]. No significant differences were found between two treatment groups at the 3-month follow-up time point [F = 0.565, P = 0.465; F = 0.228, P = 0.641; F = 0.713, P = 0.413; Z = −0.666, P = 0.505]. However, at the 6-month follow-up time point, AMS and MSS scores were significantly improved in the mCIMT group relative to the control group [F = 8.077, P = 0.013; F = 18.692, P = 0.001].ConclusionmCIMT may benefit the rehabilitation of residual upper limb dysfunction associated with a uBPI in infants.Clinical Trial Registration[www.chictr.org.cn], identifier [ChiCTR1900022119]. This paper discusses two important emphases of epistemology – of virtue and vice epistemology in particular – one concerning agency and patiency, and the other concerning self-regard and other-regard. The paper offers, for the first time in the literature, a framework in which four types of epistemological work can be categorized according to their respective dual emphases: Type 1 (agent/self-regarding), Type 2 (agent/other-regarding), Type 3 (patient/self-regarding), and Type 4 (patient/other-regarding). I argue for what I call the “Three Transitions Thesis” or “TTT” according to which four states and three transitions between them characterize such learning. I later supplement the TTT to account for learning why p. In making my case, I discuss mathematical propositions such as Fermat's Last Theorem and the ABC Conjecture, and then generalize to other mathematical propositions and to non-mathematical propositions.
